After the Deputy Speaker of the National Assembly declared the no-confidence motion of the opposition illegal and rejected it, the President of Pakistan dissolved the Assembly on the advice of the Prime Minister.
With the dissolution of the Assembly, the Prime Minister and his cabinet were dissolved.
Former Law and Information Minister Fawad Chaudhry told the media that after the dissolution of the Assembly, the incumbent Prime Minister would remain in office till the appointment of caretaker setup under Article 224 of the Constitution.
According to Article 224A of the Constitution of Pakistan, elections will be held in 90 days after the dissolution of the National Assembly. When the National Assembly is dissolved, the president will appoint a caretaker cabinet. The caretaker Prime Minister will be appointed by the President in consultation with the outgoing Prime Minister and Leader of the Opposition.
If there is no agreement between the Leader of the Opposition and the Prime Minister, the two names will be sent to the committee within three days of the dissolution of the Assembly. The Committee Speaker will immediately form the National Assembly. The committee will consist of eight members of the outgoing assembly, with an equal number of government and opposition members.
According to Article 224A, the committee will decide on the caretaker Prime Minister within three days.
In case of disagreement in the committee, the matter will be referred to the Election Commission. The Election Commission will decide within two days.
According to Article 224A, the outgoing Prime Minister will remain in office until the caretaker Prime Minister is appointed.
Cabinet Division de-notifies Imran Khan as PM
The Cabinet Division on Sunday issued a formal notification and de-notified Prime Minister Imran Khan. However, under Article 94 of the Constitution, the President has directed Imran Khan to continue as caretaker Prime Minister till the appointment of caretaker Prime Minister.
It should be noted that under Article 94 of the Constitution, the President may direct the caretaker Prime Minister to continue his work till the caretaker Prime Minister takes office.
